Terms and Conditions

1. General

  1. In the Terms & Conditions the following definitions apply:
    Company means Frankaboutyoga. Studio means the online yoga facilities offered by Frankaboutyoga. Member/ User means any person that has signed a Registration Form, and/ or acquired or downloaded a product or service, and has been accepted by the Company. Registration Form means the information provided by each user while acquiring a product or service. Terms & Conditions as defined here. Website means www.frankaboutyoga.com or affiliated websites.
  2. The Terms & Conditions are incorporated into the Registration Form & online booking systems.
  3. The Company reserves the right to vary or revoke any of the Terms & Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of the Company & the conduct of Members/ Users. Any such changes will be published on our websites &, until revoked, are binding on Members/ Users.
  4. The Terms & Conditions shall be governed by the laws of The Netherlands & subject to the exclusive jurisdiction of the Dutch courts.

2. Member/ User

  1. Subject to condition 2.2 when a person has signed a Registration Form or ticked the terms & conditions online they shall become a Member or User.
  2. Acceptance of a person as a Member or User is at the discretion of the Company.
  3. The Company reserves the right to withdraw, suspend or refuse to renew the membership of any Member whose conduct is, or may be deemed to be in the Company’s reasonable opinion, injurious to the character of the Company or amounts to a breach of the Terms & Conditions or where such expulsion is otherwise to be in the interests of the other members of the Company. Any Member so expelled shall forfeit all privileges to membership & shall not be entitled to any refund for any period during which his membership is suspended.
  4. Frankaboutyoga may run promotional introductory offers from time to time. These offers are exclusively for new students who are not already registered (members/ users) with the studio & are not for repeat use.
  5. Frankaboutyoga may run referral introductory offers from time to time. Entering fake or fraudulent referrals may result in the exclusion of referral campaigns. Abuse of the referral system may lead to Frankaboutyoga withdrawing obtained referral bonuses.
  6. For canceled memberships, access will remain available until the conclusion of the final payment cycle.
  7. Lifetime memberships are valid for the duration that Frankaboutyoga provides the specific service or product for which the membership is acquired.
  8. Frankaboutyoga reserves the right to moderate its servers and to ban any user found engaging in inappropriate behavior.
  9. In the case that Frankaboutyoga terminates a service, it’s members are not entitled to a reimbursement or compensation, and the related subscriptions will come to an end.
  10. Details of class times at the studio may vary from time to time. Class times will be published by the studio on our website. The entry to a class is closed from the moment it starts.

3. Fitness & Health

  1. Members/ Users are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Company reserves the right to refuse access to any Member/ Student if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.
  2. Members/ Users with the following conditions should not attend class or use any of the exercise or breathing products: low/high blood pressure & cardiac irregularities. If there is any doubt, the Member/ User should consult his doctor. Members & their guests must notify the Company of any circumstances affecting their health which may be exacerbated through continued use of the products or services.
  3. Members/ Users are required to follow the instructions of the teacher at all times.
  4. It is advised not to eat later than 2 hours prior to a yoga, exercise, or breathwork class. In any case, do not practice yoga, exercise, or breath work on a full stomach.
  5. By using any of our products and/ or services, the Member/ User declares that he/she is aware that it is his/ her own responsibility to take care of his/her own health and well being during such at all times.

4. Limitation of Liability

  1. The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice & in its absolute discretion & the Company shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.
  2. In the unfortunate event that, for whatever reason, Frankaboutyoga has to stop, or stops, providing a certain service, certain services or all of its’ services members are not entitled to a reimbursement, refund, or compensation.
  3. Lifetime memberships are valid for as long as Frankaboutyoga provides the product or service for which the membership is acquired.
  4. It is the Member’s / User’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any program that they follow or class that they attend. Members accept the risk of injury from performing exercises & are advised to consult their doctor prior to beginning any program or class. The Company accepts no liability for loss or damage to property or injury of Members/ Users or their guests to them on the Company premises or outside the Company except in so far as such loss, damage, or injury is by law incapable of exclusion.

5. Facility Bookings

  1. Members/ Users who show up late (failure to turn up for a class in time) will lose access to the class.
  2. All members can access the class via their zoom-link.
  3. All members can enter the class which is embedded on the event calendar page starting from 15 minutes before the class starts.
  4. All Users for online classes are requested to sign in at least 5 minutes before the class starts.

6. Payment Terms

  1. Details of class -, product – & service prices are available on our website(s) or shall be such prices as determined by the Company from time to time.
  2. Subject to any statutory right of cancellation, payments for classes, services, monthly subscription fees & annual payments are made non-refundable unless otherwise stated in the Terms & Conditions.
  3. Offline Workshops, Retreats, Services & Programmes are non-refundable. They can be credited to account if notice is given with a minimum of 2 days prior to the workshop date due to unforeseen circumstances (exceptions made for certain medical/personal circumstances at The Company’s discretion). Deposits however are non-refundable.
  4. Online & Offline products are refundable according to the statement in the Terms & Conditions.
  5. The Member / User shall make the Deposit for a product/ service or event, if applicable, as mentioned on the Registration Form. After receiving the confirmation of acceptance to the product/ service/ event, the student has 14 days to change his/her mind and withdraw their registration, with a refund of the deposit if already paid. Subject to article 5.2, after payment by the Student the Deposit will under no circumstances be refunded.

7. Monthly Autopay

  1. A Member may cancel their subscription at any time by written request to frank@frankaboutyoga.com, giving a 10 days notice before the next renewal date.
  2. A Member may cancel their subscription at any time on the membership page on their personal account. This usually works directly, but if the cancellation is done close to the next renewal date (less than 10 days in advance) this cannot be guaranteed and the member may be charged for one last month.
  3. Members shall be given no less than 30 working days’ written notice (via email) of any increase in their Subscription (unless otherwise agreed in their contract).
  4. Members agree & acknowledge that by agreeing to the minimum subscription period of one month, they are being given preferential rates, and agree that it’s fair and reasonable that the company charges them for any payments as described & referred to above.
  5. Members who do not wish to accept a change proposed by the company to the terms & conditions or to pay an increase in any subscription fee may cancel their subscription at any time by the steps described above.

8. Return/ Refund Policy

  1. Physical products returned (in original status) within 14 days will be provided with a full refund.
  2. Memberships canceled will be not be refunded. The membership will continue until the end of the payment cycle.
  3. The initial lifetime offer of 2020 is refundable until January 01, 2021.
  4. Online Workshops, Retreats, Services & Programmes are refundable if notice is given with a minimum of 7 days prior to the execution date. Deposits however are non-refundable.
  5. Online Workshops, Retreats, Services & Programmes canceled within 7 days prior to the execution date will be non-refundable, unless stated otherwise in product-specific terms & conditions.
  6. Online Courses are not refundable unless specified differently in their terms & conditions.

9. Special Offers

  1. Life-long discounts are based upon the membership, not the individual. They will remain applicable for as long as the member keeps the membership. When an individual chooses to cancel his or her membership, the life-long discount expires.
  2. Life-long discounts are applied to the principle of the most recent membership price. If at any time, the membership prices change, the company reserves the right to increase or decrease the principle to which the life-long discounts are applied.
  3. Retreat credit is valid for one year, and can be used as partial payment for designated retreats.

10. Privacy & Security Policy

  1. Your personally identifiable information is kept secure. Only authorized employees, agents & contractors (who have agreed to keep information secure & confidential have access to this information. All emails & newsletters from our sites allow you to opt-out of further mailings. Personally, identifiable information can be withdrawn via the steps outlined in the Privacy Policy. Further information about privacy & security is outlined in the privacy policy.

11. General Guidelines

  1. Members/ User’s must at all times observe the Studio guidelines which may be notified to them from time to time & are requested to comply with any reasonable directions which the teacher or management of the Company may issue to ensure the smooth operation of the Class, Products, and Services for the convenience of all Members and Users.
  2. Members are required to give written notice to the Company of any change of address, email, or contact number. Failing such notice, all communications shall be assumed to have been received by the Member within 5 days of mailing to the last address notified to the Company.
  3. The Company reserves the right to refuse admission to the Classes, Products & Services
  4. The Company may if a Member or User so wishes communicate with the Member by email. By providing an email address to the Company the Member or User consents to receive email communications from the Company, including notices pursuant to the Terms & Conditions. The Member also accepts any risk that email may not be a fully secure & confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member or User in this manner.

12. Dress & Footwear

  1. Members or Users are requested to dress appropriately to the practice of Yoga. Footwear, including socks, should be removed before the start of the class.

13. Use Of Facilities

  1. Member / User is entitled to use the Company’s facilities during scheduled class times providing always that the Company may at any time withdraw all or part of its facilities for any period or periods & with notice, where practicable, in connection with any leaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.
  2. Children under the age of 16 may only use the products, services & classes if accompanied by an adult & when under their care & supervision, however, the Company reserves the right of refusal for any minor to practice according to clause Fitness & Health 1.
  3. Children under the age of 18 may only purchase products, services & classes with the consent of their supervisor. As it is practically not possible to verify this for online purchases, consent is implied on purchase. Implied consent can be withdrawn within 30 days after the transaction, except in so far as by law this is determined differently. 14. Personal Belongings

  1. Personal belongings are brought into the Company premises at the Member’s / User’s risk & the Company does not accept liability for any loss or damage whatever to such items. For security reasons, Members and Users are advised not to bring valuable belongings to the Company or any of its’ venues.

15. Website Terms & Conditions

  1. Information published on this web site is provided for the use of its visitors & you are advised that, although care has been taken to ensure technical & factual accuracy, some errors may occur. No guarantee is given of the accuracy or completeness of information on these pages. Please be aware that Frankaboutyoga may alter the information on its website from time to time. Frankaboutyoga shall have no liability arising from the use by any party of the information on this website. Frankaboutyoga does not warrant the information on this website in any way and particular no warranty is given that the website or its contents or hypertext links are virus free or uncontaminated. You are advised to make your own virus checks and to implement your own precautions in this respect. Frankaboutyoga excludes all liability for contamination or damage caused by any virus or electronic transmission.

16. Copyright

  1. All Frankaboutyoga materials are under the copyright protection of Frankaboutyoga and cannot be reproduced by the User/ Member without the permission of the author. Failure to comply may result in legal action.
  2. Pictures and videos might be taken during the classes and published via our marketing communication. These pictures are under the copyright of Frankaboutyoga.

17. Applicable Law, Dispute Resolution, Prevailing Language

  1. Dutch law applies exclusively to the conditions.
  2. In case of complaints, please send an e-mail to frank@frankaboutyoga.com.
  3. After sharing your complaint with us through email, you will receive an answer by email within 2 weeks. The complaint will be handled and solved within a maximum of 60 days from the first contact if within 60 days the issue is not solved, another 60-day extension to solve the issue applies. In case resolving and the processing the complaint takes longer than the initial 60 days, the student will be notified before the end of the 60 days on the status, and a new estimate will be given on why it is taking longer and a new estimate of the date of finalizing the complaint will be provided.
  4. The complaint will be handled with care and protection of the privacy of the complaining party. Also, the complaint will be archived and stays retrievable for a period of 1 year from the first contact.
  5. Classes, products & services are primarily given in English.
